Terms of Service

1. Scope

These Terms of Service apply to all orders placed through our online shop Vlad | Photography Art (the “Shop”). By accessing or purchasing from our Shop, you agree to these Terms and our Privacy Policy.

 

 

2. Products

All works offered are fine art prints of original photographs by Vlad | Photography Art.
 Prints are produced on demand by WhiteWall.
 Colors, tones, or proportions may differ slightly from screen previews due to monitor and device settings.

 

 

3. Orders & Contract

By placing an order, you make a binding offer to purchase.
 A contract is concluded once you receive an order confirmation email.
 We reserve the right to decline or cancel orders in justified cases (e.g., pricing or technical errors).

Note: Only prints are available; mixed orders (prints + other products) are not possible.

 

 

4. Right of Withdrawal / Returns

As all prints are custom-made, orders cannot be cancelled or returned for preference reasons (e.g., size, color).

Exception: Damaged or defective prints may be returned or replaced if reported within 12 days of delivery with photos of the issue.

 

 

5. Prices & Payment

All prices shown are in EUR. As a small business under Austrian law (Kleinunternehmerregelung), we do not charge VAT in accordance with § 6 Abs. 1 Z 27 UStG.

“Gemäß § 6 Abs. 1 Z 27 UStG wird keine Umsatzsteuer berechnet.”

This means:

  • No VAT is added to your purchase.
  • We cannot issue VAT deduction for business purposes.
  • Shipping costs, customs duties, or local taxes may still apply depending on your delivery address and are the responsibility of the buyer.
  • Country-Based Pricing (Romania)

For customers in Romania, prices may be displayed or processed in RON based on regional settings or payment provider requirements.
 This ensures accurate currency conversion at the time of purchase.
 Regardless of the shown currency, all payments correspond to the EUR base price of the product.

Payment is processed via the secure methods provided in the Shop. Orders will only be produced once full payment has been received.

 

 

6. Shipping & Delivery

  • Production, packaging, and shipping are handled by WhiteWall.
  • Delivery times are estimates and not guaranteed.
  • Delays caused by carriers, customs, or external events are beyond our control.
  • Risk passes to the buyer once the print is handed over to the shipping carrier.

 

 

7. Intellectual Property

  • All photographs and prints are original works by Vlad | Photography Art.
  • Purchase grants ownership of the physical print only.
  • Copyright, reproduction, and commercial rights remain with the artist.

 

 

8. Liability

  • We are liable only for damages caused intentionally or through gross negligence.
  • For minor negligence, liability is limited to breaches of essential contractual obligations and foreseeable damages.
  • Liability for indirect, consequential, or lost profit damages is excluded unless legally required.

 

 

9. Governing Law & Jurisdiction

  • These Terms are governed by the laws of Austria.
  • Jurisdiction is the registered business address of Vlad | Photography Art, unless mandatory consumer protection laws state otherwise.

 

 

10. Changes to Terms

We may update or modify these Terms at any time. The version valid at the time of order applies.
